BusyBissy Media Productions within this document and outside it is also known as BBMP.
- BASIC REQUIREMENT
- Eligibility: All interested persons or organisations are free to engage BBMP on the creation of a website under the promotion. However, only Nigerians are in focus for this promotion irrespective of their physical location globally. BusyBissy Media Productions is subject to all applicable federal, state and local laws and regulations in Nigeria only and thus engaging clients are subject to same even if from other countries.
- Agreement to Operational Systems: By soliciting and engaging BusyBissy Media Productions' products and services, you agree to their Operational Systems as stated below.
- OPERATIONAL SYSTEM
- Brand Integration: BusyBissy Media Productions' currently operational logo will be crafted into every client's website in subtle locations with a linkback. This may be accompanied by text or not at the sole discretion of BusyBissy Media Productions. Any express desire by clients to have our credits completely taken off will attract a one-off payment of N50,000 (Fifty thousand naira) per website. However, payment made for this purpose will remove all BBMP credit on project but can still be used for claims as the project creator.
- Business Engagement: To successfully engage the services of BusyBissy Media Productions, the following protocols must be observed.
- Jan2022 Website Promo Form: This must be filled to officially acknowledge the request for BBMP website promotion services, irrespective of verbal understandings or conclusions. In it must be all key information for website creation and one off payment for the service
- Website Creation Feedback Form: At the end of the project, clients are obligated to give feedback via this form for the service rendered. This will activate our promise to promote same website on our social pages.
- Production Process: The target is to be done in 5 days. Day 1 is counted the next day after form is received with payment. Client is contacted to confirm information and given feedback on choice name availability etc. The first draft is shared on the 3rd day and final job is delivered by the 5th. The only reason for possible extension of final website delivery would be if clients make rigorous edits to the draft shared, which may require more drafts being shared before the final delivery. Once job is delivered, Clients are expected to give feedback within 48 hours to activate our promise to help promote the website on our pages.
- Payment Process: Full payment is made at the start of the project either directly online or assigned code is uploaded to form if paid offline (via bank, app/mobile transfer etc).
- Website Management: BBMP will continually manage the running of the contents and functionality of the websites opened through this promotion for the next 5 years, after which the management will be handed over to the client at no extra charge. However, any desire to revoke our management rights before the end of this period will attract only a charge of N100,000 per year left before official handover also calculable in months. Your site management by us terminates by 1st of February 2027. Prior to this time, clients will pay a yearly fee as determined by the current rating for domain name renewals starting 11 months after site is launched and a token of N2000 per page editing after the initial creations. In the case of adding more articles (posts) N5000 and more pages N10,000 per each. Please note these rates may increase based on the economic situations affecting the cost of operations in the country. Editing herein entails correcting, removing or adding to content already on the website.
- INDEMNITY
- Refunds Policy: BusyBissy Media Productions reserves the rights to stop production of a client's project if it alters significantly from the initial Invoice content approved by client. There would be no refunds of any paid amount in this instance. Where it is the client withdrawing his patronage for reasons not caused by a breach of agreement by BBMP, there would be no refunds at this instance. If, however, the cause of project termination is due to no faults of the client, BBMP will refund 90% of payment made provided custom name has not been bought, otherwise only 20% of the funds will be refunded.
- Content: The client is responsible for the implication and claims of product contents. Inclusion of BusyBissy Media Productions' brand name or logo does not symbolize endorsement of content but merely an attribute as the creator of the creative content for the content owner.
- Disputes: BBMP PROJECT EXECUTION IS GOVERNED BY THE LAWS OF Nigeria AND [Cross River State, WITHOUT RESPECT TO CONFLICT OF LAW DOCTRINES. As a condition of engaging our creative services, clients agree that any and all disputes which cannot be resolved between the parties, and causes of action arising out of or connected with projects carried out by BusyBissy Media Productions shall be resolved individually, without resort to any form of class action, exclusively before a court located in Cross River State having jurisdiction. Further, in any such dispute, under no circumstances will the client be permitted to obtain awards for, and hereby waives all rights to claim punitive, incidental, or consequential damages, including reasonable attorneys' fees and the client further waives all rights to have damages multiplied or increased.
- Limitation of Liability: By engaging BBMP' services, you agree to release and hold harmless BusyBissy Media Productions and its subsidiaries, affiliates, advertising and promotion agencies, partners, representatives, agents, successors, assigns, employees, officers and directors from any liability, illness, injury, death, loss, litigation, claim or damage that may occur, directly or indirectly, whether caused by negligence or not, from (i) such client's engagement of BBMP as a paying customer and/or his/her acceptance, possession, use, or misuse of the product produced by BBMP from such engagement or any portion thereof, (ii) technical failures of any kind, including but not limited to the malfunctioning of any computer, cable, network, hardware or software; (iii) the unavailability or inaccessibility of any transmissions or telephone or Internet service; (iv) unauthorized human intervention in any part of the business partnership or production process; (v) electronic or human error which may occur in the production of the project.
All payment correspondences are addressed to BusyBissy Media Productions and same has the right, in its sole discretion, to maintain the integrity of her operational indices and subsidiaries. Any attempt by a client to deliberately damage any of BusyBissy brand online and offline or undermine the legitimate operation of the BusyBissy Media Productions may be a violation of criminal and civil laws and should such an attempt be made, BusyBissy Media Productions reserves the right to seek damages from any such person to the fullest extent permitted by law.
